Congress passed EMTALA in 1986 as part of the Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985 (42 U.S.C. §1395dd. It aimed to prevent hospitals from sending Medicaid or uninsured patients to public hospitals without, at the very least, giving them a medical screening check to make sure they were stable enough to be transferred. Because of this, regional and state governments started delegating charitable care oversight to all hospitals. EMTALA became the de facto national health care policy for those without insurance. EMTALA mandates that emergency departments at Medicare-participating hospital facilities screen and address patients’ emergency medical problems without regard to their capacity to pay, insurance status, national origin, race, creed, or colour. C.M.S. formed a technical advisory committee in 2005 to research EMTALA. In addition to allowing and encouraging communities to test new emergency healthcare system designs, such as direct patient transfer to non-acute care facilities like dialysis centres and outpatient surgical clinics when necessary, a new EMTALA would work to protect patients from unequal treatment.
